Online Resources: Using the CLA Digitisation Licence

What is the CLA Digitisation Licence?

It enables universities to digitise some materials without applying individually to the copyright holder. The licence allows the posting of digitised material, which has been copyright cleared and paid for, on a VLE, such as StudyZone, or a secure intranet for the use of students on specific courses.

How can I arrange for material to be digitised?

  • Digitisation will be managed by Library & Learning Services as a service to the whole University.
  • To request digitisation, complete the form, and hand it to the Enquiry Desk at the Library.
  • If you have any questions about the service, please ask your Academic Liaison Librarian

What can be digitised?

The Licence covers digitisation of most printed material that is published in the UK and the USA and where the University owns an original copy. Excluded works and excluded material cannot be digitised under this licence. Copying and digitising of excluded material may be covered by other licences and agreements.

What are the categories of excluded material?

The Licence applies to most material published in the UK and USA only. The place of publication is usually on the title page, and/or the page after the title page of a book or the cover of a journal. In the case of multinational publishers or items which have more than one place of publication, the main place of business of the publisher should be used. Categories of Excluded Material which may not be copied under the Licence are works that consist of the following:

  • printed music (including the words);

  • maps, charts, books of tables;
  • texts of public examination papers whether published individually or in collections;
  • workbooks, work cards and assignment sheets;
  • privately owned documents issued for tuition purposes and limited to clientele who pay fees;
  • newspapers;
  • industrial house journals and other free publications primarily for employees of commercial businesses, industrial undertakings or public services;
  • any work on which the copyright owner has expressively and prominently stipulated that it may not be copied under this Licence.

How much of a work can be digitised?

  • one chapter or 5% of a book, report or pamphlet;

  • no more than one article from a journal issue;
  • one short story/poem (maximum of 10 pages) from an anthology;
  • one case from law reports.

Can I include requests for photographs or other illustrations in my StudyZone module?

The CLA Licence permits the photocopying and/or scanning of pages in printed books or journals of pages that consist wholly of text, pages that consist wholly of images (e.g. illustrations, photographs, and other works produced by visual creators) and of pages consisting of a combination of text and images.

The licence also permits a digital copy to be prepared of a whole page visual image

How can the digitised material be distributed?

Digital material may be made available to students and staff on a specific course using a secure network (StudyZone, (StudyZone) or a password protected page) or may be distributed on disk or CD ROM to students on a specific course. Digital copies may also be displayed using standard presentation software (such as PowerPoint) to be viewed by staff and students on a course of study for the purpose of illustrating a lecture or tutorial.

Once digitised, no more than one copy per student on the course may be printed.

Electronic copies downloaded from course collections cannot be transmitted by email

The same extract of a book or journal can be made simultaneously available to students on more than one course of study and a digital copy of a different part of the same book or journal can be made available to students on another course of study.

Can I use the digitised material in all my StudyZone modules or on my school web pages?

Material is digitised for specific StudyZone modules only and not for open access web sites such as department web pages or library catalogues. If you need to use the same digitised material in more than one StudyZone module, please submit a separate request for each module concerned.

What happens to the digitised material once the course has finished?

At the end of the course, access to the digital material must be removed by the eLearning team.

The material may be used for other courses or for the same course when it runs again.
